By registering to bid or bidding in any AuctionUbid sale, you agree to the following terms. These terms are governed by North Carolina law.
01 Buyer's Premium
A 15% buyer's premium is added to all purchases, plus 7.25% North Carolina Sales Tax unless a valid NCDOR Tax Exemption Form is on file.
02 Payment
Credit cards are automatically charged upon auction close. The auctioneer may suspend bidding privileges if a card fails to charge twice. You agree that you will not charge back any amount that the auctioneer charges to your credit card.
03 Winning Bids
Winning bids obligate payment at the bid price and are subject to auctioneer certification. Paid sales receipts are typically sent by end of business day. Bid inquiries must be reported by 9:00 am EST the day after the auction closes via the online form.
04 No Warranties
All property sells "AS IS" and "WITH ALL FAULTS," if any. The auctioneer disclaims responsibility for liens, encumbrances, and technology-related issues.
05 Auctioneer's Disclaimer
All descriptions are provided without warranty. Property sells "AS IS, WHERE IS" with all faults.
06 Conduct of Sale
All transactions are in U.S. Dollars. Bidders may not interfere with sale operations or reproduce website content without written permission.
07 Pick-Up / Removal
Items must be paid in full before removal and taken on auction day unless prior arrangements are made. Late-removal fees apply: $200 minimum for the first hour, $75 per additional hour.
08 Accidents
Attendees assume all risk. The seller and auctioneer bear no responsibility for accidents.
09 Absentee Bids
Staff cannot guarantee placement of absentee bids. Full payment is required before removal.
10 Choose Wisely
Bidders may not withdraw bids or refuse payment due to inspection failures or buyer's remorse.
11 Reporting Bidding Errors
Bidders must refresh their browser frequently and report errors via the online form only, before the auction closes.
12 Timeliness of Bidding-Error Reports
Errors reported after the auction closes cannot be undone.
13 Bidder's Duty to Report Fraud
Account holders must immediately report unauthorized access via webchat and to law enforcement.
14 Changes in Circumstance
The auctioneer may add or remove items, split or combine lots, adjust times, or cancel sales at any time.
15 Liability
The auctioneer's liability will be limited to the refund of your purchase price. The auctioneer disclaims liability for site malfunctions, third-party actions and equipment failures.
16 Indemnification
Bidders indemnify the auctioneer against all claims involving personal injury, property damage, or violations of these terms.
17 Disposal of Unclaimed Items
Abandoned items may be resold, removed, stored, or disposed of. Bidders are responsible for all deficiencies and associated costs.
18 Governing Law
North Carolina law governs these terms.
19 Entire Agreement
These terms supersede all prior agreements.
